These General Terms and Conditions of Sale (hereinafter "Terms") apply to all purchases made via the buyphone.be website. By placing an order, you agree to be bound by these Terms.

1. Scope

These Terms govern the contractual relationship between buyphone OÜ ("the seller") and any user acting as a consumer ("the buyer") making purchases via the website. They supersede any other conditions not explicitly agreed upon by the seller.

2. Products and Availability

Products displayed on the website are subject to availability. Descriptions and images are intended to give the buyer the most accurate possible representation of the product. Minor variations (color rendering, packaging) may exist without affecting the essential characteristics of the product.

In the event that a product becomes unavailable after an order has been confirmed, the buyer will be notified without delay via email and may choose to either receive a full refund or adjust the order.

3. Pricing and Payment

Prices are listed in euros (€) and are inclusive of VAT at the rate applicable in the buyer's country of delivery at the time of purchase. Delivery charges are not included in the displayed product prices and will be explicitly stated before the order is finalized.

Available payment methods: Credit card, Apple Pay, Bancontact, and Stripe.

The seller retains ownership of the goods until full payment has been received.

4. Ordering Process

To place an order:

• Create an account or log in as a guest.
• Add items to your cart.
• Confirm the order and provide payment details.
• An order confirmation email summarizing the purchase will be sent to the buyer without delay.

5. Delivery and Transfer of Risk

Delivery is available to European countries serviced by our designated shipping carriers. The specific countries available for selection and their corresponding shipping fees are displayed during the checkout process before order finalization.

The seller commits to delivering the goods within the timeframe specified during the checkout process or, if no timeframe is specified, within a maximum of 30 days from the conclusion of the contract.

The seller bears the risk of loss or damage to the goods until they are physically delivered to the delivery address specified by the buyer or to a third party designated by them.

6. Right of Withdrawal

In accordance with European Union consumer protection laws, the consumer has a period of 14 calendar days to withdraw from their purchase, without providing any reason, starting from the day after the product is received.

To exercise this right, the buyer may either:

• Fill in our online withdrawal form, or
• Send any other clear written statement of their decision to info@buyphone.be.

The direct costs of returning the goods shall be borne exclusively by the buyer. Products must be returned in their original packaging, complete, and in perfect condition for resale. Any sealed goods that have been unsealed by the consumer after delivery, and which cannot be returned for health protection or hygiene reasons, are excluded from the right of withdrawal.

The seller will refund all payments received, including the costs of standard delivery, within 14 days of receiving the withdrawal notice. The seller may withhold the refund until the goods have been received back or until the buyer has supplied evidence of having sent back the goods, whichever is the earliest.

7. Legal Warranty

All products sold are covered by a mandatory two-year (2) legal warranty of conformity under European Union law. In the event of a product defect or non-conformity with the description, the buyer is entitled to request repair, replacement, a price reduction, or the rescission of the contract, free of charge.

8. Limitation of Liability

The seller is responsible for the proper performance of the contractual obligations. However, the seller shall not be held liable for any non-performance or improper performance of the contract that is attributable either to the buyer, to an unpredictable and insurmountable act of a third party, or to an event of force majeure.

Nothing in these Terms shall limit or exclude the seller's liability for death or personal injury caused by negligence, or for any other liability that cannot be limited or excluded under applicable law.

9. Personal Data

Personal data collected during the ordering process is processed in accordance with our Privacy Policy, in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia, without prejudice to the application of the mandatory consumer protection provisions of the buyer's country of residence.

In the event of a dispute, the buyer may choose to bring legal proceedings either before the courts of Estonia or before the competent courts of their own place of residence.

11. Out-of-Court Dispute Resolution

In accordance with Directive 2013/11/EU, the buyer may, in case of dispute, contact a competent consumer mediator in their country of residence before initiating legal proceedings:
